The Maritime Industry basically revolves around ships, the seas and the borderless global business it deals in. Therefore, it helps to start with the basic rule that every merchant ship/vessel needs to be registered to a state of its choice. Once registered, the ship is then bound to carry the flag of that state (i.e., the ship’s Flag State) and is accordingly bound by the rules and regulations enforced by the same.

The practice of registering the ship to a state different than that of the ship’s owner is known as Flag of Convenience (or FOC). Now here's the legal aspect slightly more appropriate for your Paralegal colleagues, but nonetheless one that also associates the potential for high-paying careers in this field. In order to be included in the list of Flag States, a shipper has to have the necessary financial and technical maritime foundation that outlines the shipper’s ability to be a legitimate maritime operation, in other words, a large enough business ability to produce and perform.

On a side note, there is also a balance that has to be struck between the commercial advantages of selecting a particular flag and the need to discourage the use of flags that do not meet their international obligations. Then it must adhere to all the standards and regulatory mandates established by the International Maritime Organization (IMO), the agency of the U.N. established in 1948 that is responsible for regulating shipping industries.
